You are absolutely correct. Members have to be made aware of the email when they sign up. There are two ways you can do it.
- If you feel confident enough about your site, you can "inform" them that they WILL receive the newsletter as a condition for registering and that they can unsubscribe at any time after that. Be sure to make it ABSOLUTELY clear that it is a condition of the registration. Put the statement right above the "Accept" button, in bold letters - not kidding.
- The other way is providing a check-box (checked by default) at the time they register that allows them the option to NOT receive the newsletter.
I developed a links site that used option #1 above and the site has 50k+ members today.
A side note to this is that my site in question above, DID get reported once for spamming. We had to convince our hosting provider that we were in fact NOT spamming.
So its a game that you play. Take the risk and try to get the traffic and the members or play it safe and still get members, just not as many newsletter subscribers.
